The dangers of asbestos have long been documented but never has it been more prevalent until the recent court ruling that potentially leaves company insurers paying out as much as £5bn to relatives of those who have died from asbestos-related cancers.
Some claims have dated back from the 1940’s and the court ruling states that insurance liability is from the time an employee was exposed to asbestos, not when the symptoms appeared.
Lord Clarke said “The negligent exposure of an employee during the insurance policy period has a sufficient casual link with subsequently arising mesothelioma to trigger the insurer’s obligation.”
With asbestos-related diseases causing more than 5,000 deaths every year, it is vital that people who have the potential to be exposed are adequately trained and know the dangers.
